1. Acceptance of Terms
Welcome to Masters Africa ("Platform", "we", "us", or "our"), operated by Masters Africa Ltd. By accessing or using our website at masters.africa, mobile applications, or any related services, you ("User", "you", or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.
We reserve the right to update or modify these Terms at any time. Changes become effective upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. Account Registration
To access certain features of the Platform, you must create an account. Masters Africa supports the following account types:
- Job Seeker — Individuals seeking employment opportunities across Africa. Job Seekers may upload CVs, apply for jobs, register for events, and manage their professional profiles.
- Employer — Companies, organisations, or individuals posting job vacancies. Employers may publish job listings, review applications, and manage recruitment workflows.
- Agency — Recruitment and staffing agencies that post jobs and manage candidates on behalf of client organisations.
- Consultant — Independent recruitment professionals or HR consultants offering services through the Platform.
When registering, you agree to: (a) provide accurate, current, and complete information; (b) maintain and update your information to keep it accurate; (c) maintain the confidentiality of your account credentials; and (d) accept responsibility for all activities that occur under your account. You must be at least 18 years of age to register. You may not create multiple accounts for the same purpose or transfer your account to another person without our written consent.
3. User Content & Listings
The Platform allows Users to create, upload, and share various types of content, including but not limited to:
- Job Listings — Employers and Agencies may post job vacancies that must accurately describe the position, requirements, compensation (where applicable), and working conditions.
- CVs & Profiles — Job Seekers may upload curricula vitae, cover letters, portfolios, and professional profiles. You are solely responsible for the accuracy of information in your CV.
- Events — Users may create, promote, or register for career-related events such as job fairs, webinars, workshops, and networking sessions.
- Reviews & Comments — Users may post reviews, ratings, and comments in areas where such features are available.
By submitting content to the Platform, you grant Masters Africa a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. You retain ownership of your content. You represent and warrant that you have all necessary rights to submit such content and that it does not infringe on the rights of any third party.
4. Prohibited Conduct
You agree not to use the Platform to:
- Post fake, fraudulent, or misleading job listings, including positions that do not exist or misrepresent compensation, responsibilities, or working conditions.
- Engage in employment discrimination based on race, ethnicity, gender, religion, disability, age, sexual orientation, nationality, or any other characteristic protected by applicable law.
- Send unsolicited messages, spam, or bulk communications to other Users.
- Collect, harvest, or store personal data of other Users without their explicit consent.
- Post content that is defamatory, obscene, threatening, or otherwise objectionable.
- Require job applicants to pay fees as a condition of employment consideration (pay-to-apply schemes).
- Impersonate any person or entity, or falsely represent your affiliation with a person or entity.
- Use the Platform for any illegal purpose or in violation of any applicable local, national, or international law.
- Attempt to gain unauthorised access to other User accounts, the Platform's systems, or any connected networks.
- Use automated tools, bots, or scripts to access the Platform, scrape data, or submit content without our prior written permission.
- Post listings for multi-level marketing schemes, pyramid schemes, or similar arrangements disguised as employment.
5. Fees & Payments
Masters Africa offers both free and paid services. Certain features, including premium job listing placements, membership plans, and enhanced employer profiles, require payment.
- Membership Plans — We offer subscription-based membership plans for Employers, Agencies, and Consultants. Plan details, pricing, and features are described on our pricing page and may change from time to time. Changes to pricing will not affect active subscription periods.
- Payment Processing — Payments are processed securely through third-party payment processors, including Stripe and PayPal. By making a payment, you agree to the terms of service and privacy policies of the applicable payment processor. Masters Africa does not store your full credit card or payment details on our servers.
- Refunds — Subscription fees are generally non-refundable. However, refund requests may be considered on a case-by-case basis within 14 days of purchase if the paid service was not substantially delivered. To request a refund, contact us at info@masters.africa.
- Currency — Prices are displayed in US Dollars (USD) unless otherwise indicated. Currency conversion fees applied by your bank or payment provider are your responsibility.
- Taxes — You are responsible for any applicable taxes, including VAT, associated with your use of paid services.
6. Intellectual Property
All content, trademarks, logos, service marks, trade names, designs, graphics, and software on the Platform are the property of Masters Africa or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Platform content without our prior written consent.
The Masters Africa name, logo, and all related product and service names, design marks, and slogans are trademarks of Masters Africa Ltd. You may not use these marks without our prior written permission.
7. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. Masters Africa makes no warranties or representations, express or implied, regarding the Platform, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.
Masters Africa does not endorse, verify, or guarantee the accuracy of job listings, employer profiles, candidate qualifications, or any other User-submitted content. We are not a party to any employment agreement between Users and do not act as an employer, recruiter, or employment agency.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Masters Africa, its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform.
Masters Africa shall not be liable for: (a) any employment decisions made by Employers or Job Seekers based on information found on the Platform; (b) the conduct, whether online or offline, of any User; (c) any content posted by Users, including job listings, CVs, or communications; or (d) any loss or damage arising from unauthorised access to your account. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Masters Africa, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to the Platform.
10. Account Termination
You may deactivate or delete your account at any time through your account settings or by contacting us at info@masters.africa. Upon account deletion, your profile and associated content will be removed from public view, though certain data may be retained as required by law or for legitimate business purposes (such as resolving disputes).
We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to other Users or the integrity of the Platform. Termination of your account does not relieve you of any obligations incurred prior to termination, including payment obligations.
11. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or your use of the Platform, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through mediation or arbitration in accordance with the rules of a mutually agreed arbitration body.
12. Governing Law
Masters Africa operates across multiple African jurisdictions. These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where the relevant dispute arises, unless otherwise required by mandatory local law. For Users in South Africa, the Consumer Protection Act, 2008 and the Protection of Personal Information Act, 2013 (POPIA) apply to the extent relevant. For Users in Nigeria, the Nigeria Data Protection Regulation (NDPR) applies. For Users in Kenya, the Data Protection Act, 2019 applies. For Users in other African countries, local consumer protection and data privacy laws apply as applicable.
Nothing in these Terms shall limit any rights you may have under mandatory consumer protection laws in your country of residence.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
